Who you're contracting with

Onyx is the trading name of Onyx AI Solutions, a business owned and operated by Pedro Sosa in Exeter, California. Onyx and Onyx AI Solutions refer to the same entity throughout this document.

Card payments appear on your statement as WITHONYX.DEV, and on some statements as ONYX followed by the product name. If you see a charge you don't recognize, email pedro@withonyx.dev before disputing it and I'll sort it out the same day.

01

What you're buying

Onyx sells three things: hand-coded websites, Google Business Profile and local SEO setup, and AI phone answering. What's included in your project is whatever is written in the quote or order you approved — the tier name, the page count, and any add-ons.

Anything not written down isn't included. If you want something added mid-project, I'll quote it before I build it.

02

Payment

Build projects are half up front and half on the day the site goes live. Work starts when the deposit clears.

Monthly website plans have a setup fee due before work starts, then a recurring monthly charge beginning the day the work goes live. Monthly website plans carry a twelve-month minimum term; after that you can cancel any month. The AI phone line is month-to-month and can be cancelled any month.

Payments are processed by Stripe. I never see or store your full card number.

03

Refunds

If you don't like the first design, you can walk away and owe nothing further — you keep what was delivered and the deposit covers the work already done. That's the guarantee stated on the site.

Once a site is live, or once a phone line has been configured and answered calls, that month's work isn't refundable. Setup fees are not refundable after work has started.

If I can't deliver what was quoted, I refund the deposit in full.

04

Timelines

Most builds go live in about two weeks from the day I have your content, photos, and account access. That estimate assumes you respond to questions within a couple of business days.

If content or access is delayed on your side, the timeline moves. I'll tell you when that happens rather than quietly slipping.

05

Who owns what

You own your domain, your content, your photos, and the code I write for your site. On final payment it's yours outright — if you leave, it goes with you and I'll help hand it over.

I keep the right to show your finished site as an example of my work, and to reuse generic techniques and non-client-specific code in other projects.

You're responsible for having the rights to any photos, logos, or copy you give me.

06

Hosting and uptime

Hosting, domains, and email may run through third-party providers. I set them up and keep them working, but I don't control their networks and can't promise a specific uptime figure.

Care plans and monthly plans include security updates and fixes. They don't include unlimited redesigns — monthly plans include one round of changes per month.

07

The AI receptionist

The AI answers calls using a script you approve. It can only state prices, hours, services, and policies you've given me. When it isn't sure, it takes a message or books a callback rather than guessing.

It is not a person and it is not an emergency service. Don't route life-safety calls to it. Real emergencies and anything delicate are handed off to you.

Plans are priced by call volume band and billed flat — no per-minute charges. If your volume consistently exceeds your band, I'll tell you and move you up a tier rather than send a surprise invoice.

08

Call recordings and consent

California is a two-party consent state. If your line records or transcribes calls, callers must be told at the start of the call. I'll configure that disclosure, but as the business owner you are the party responsible for consent on your own line.

Call transcripts and message summaries belong to you. I access them only to fix problems or improve your script when you ask.

09

What I collect on this website

The free audit tool reads the public page at the address you type in and scores it in your browser. To fetch that page it passes the address through one of two public read-only proxies, r.jina.ai or api.allorigins.win, which is the only place your typed address goes. Nothing is sent to an AI service, nothing is stored on my end, and it doesn't ask for your name or set a cookie.

If you ask me to send you the written audit, the phone number or email you type — plus that report — comes to me directly so I can reply. I use it to answer you, nothing else, and I delete it on request.

If you book a call, that goes through Calendly and you give them your name, email, and phone. If you pay, Stripe collects your payment and billing details. Both have their own privacy policies.

I count page views with a cookieless analytics tool so I can see which pages people actually read. It records no names, no IP-based profiles, and nothing that identifies you personally.

This site doesn't run advertising trackers or sell data to anyone. Ever.

10

Your data rights

You can ask me what information I hold about you, ask for a copy, or ask me to delete it — email pedro@withonyx.dev and I'll handle it within thirty days.

California residents have additional rights under the CCPA, including the right to know and the right to delete. Onyx does not sell personal information, so there is nothing to opt out of.

11

Liability

I build carefully and I stand behind my work, but I can't be responsible for lost revenue, missed calls, search ranking changes, or third-party outages. My total liability is limited to what you paid me for the work in question.

Search rankings depend on Google, your competitors, and your reviews. I do the technical and local SEO work properly; I don't promise a specific position.

12

Ending the relationship

Either of us can end the AI phone line any month, or a monthly website plan after its minimum term, with notice before the next billing date. I'll forward your phone line back to you the same day and hand over accounts and code.

I may decline or end work if a project turns out to be illegal, fraudulent, abusive, or outside what I can do well — in that case you only pay for work completed.

13

Changes and governing law

If I change these terms, the version in effect when you signed off on your project governs that project. The date at the top shows when this page last changed.

These terms are governed by the laws of the State of California, and any dispute belongs in the courts of Tulare County.
